1. PURPOSE OF THE AGREEMENT

By accessing or using the Site, you acknowledge that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions (including the Payment Policy, Shipping Policy, Return Policy and Privacy Policy). If the Customer purchases a product offered for sale on the Website through the Internet, this mutual agreement shall be considered a Distance Contract and shall be subject to the legal rules governing distance contracts, including but not limited to Directive No. 97/7/EC of the European Parliament and of the Council on the protection of consumers in respect of distance contracts, the Romanian Consumer Rights Protection Law, the Romanian Regulation on Distance Contracts. If you purchase a product, you will receive an automatic e-mail, by which the contract is concluded.

2. CONCLUSION

Product descriptions displayed in the online shop do not constitute binding offers. By clicking the “place an order” button after completing the purchase form and agreeing to the terms of use, installation and handling of the product, the customer makes a binding offer to enter into a purchase contract with DIGITALSTEEZ in accordance with the terms contained in the form on the purchase page. DIGITALSTEEZ is not obligated to accept the offer. DIGITALSTEEZ sends a purchase confirmation (PROOF) to the e-mail address indicated by the customer, so that the purchase contract is concluded.

3. INTELLECTUAL PROPERTY

All intellectual property rights, including but not limited to trademarks, text and logos displayed on our products, belong exclusively to their respective owners. Our rights and claims relate only to the specific products, designs and images offered under the DIGITALSTEEZ brand (Trademark registered at the European Union level) and are protected by international laws governing the protection of intellectual property, including laws governing copyrights and trademarks. Our trademarks may not be used in any way for any purpose without our express written consent.

4. DISCLAIMER WEBSITE

DIGITALSTEEZ does not warrant that the information provided on the Site is accurate, complete or up-to-date. DIGITALSTEEZ reserves the right to correct any errors, inaccuracies or omissions and to change or update the information at any time without prior notice (including after the Customer has submitted the Customer Order). Product images on the Site are for reference only. Actual product appearance may vary slightly. We try to be as accurate as possible when describing our products on the Site. If product information (image, description, colors, etc.) has changed, DIGITALSTEEZ cannot guarantee that the data posted on the Site at any time contains all the latest updates. Every effort is made to keep the Site running smoothly. However, DIGITALSTEEZ takes no responsibility for, and will not be liable for, the Website being temporarily unavailable due to technical issues beyond our control.

Through links posted on this Site, you may access other sites that are not under the control of DIGITALSTEEZ. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

5. CULORIES

All the colors on the WRAPS.DIGITALSTEEZ.EU website have been represented as accurately as possible with the market requirements as well as aftermarket colors of some manufacturers/designers. However, accuracy depends on monitor settings and calibration. In most cases, colors will vary slightly.

However, for a better handling of the whole process including colors, we introduce a comparison guide of our colors versus RAL and PANTONE standards. Our post order release proofs are submitted in the CMYK color spectrum. Sometimes our website mockups have these colors adjusted so that they actually reflect how the CMYK colors will come out after printing and finishing, so you will be able to see the differences between the product on the website and the mockup.

Also keep in mind that not all RAL or PANTONE colors do not match 1:1, so there is a risk that our colors may not match 1:1 either.

6. USER RESPONSIBILITY

In accessing or using the Site, you will abide by these Terms and Conditions, the Payment Policy, the Shipping Policy, the Return Policy and the Privacy Policy and the instructions for access or use posted on the Site. You will always act in accordance with the law, custom and in good faith. You may not make any changes or modifications to the Site or any Content or service that may appear on the Site and may not in any way affect the integrity or functioning of the Site. Without limiting the generality of any other provision of these Terms and Conditions, if you negligently or willfully default in any of the obligations set forth in these Terms and Conditions, you will be liable for all loss and damage that this may cause WRAPS.DIGITALSTEEZ.EU, our affiliates, partners or licensors.

7. PRICES AND PAYMENT PROCESS

The prices on WRAPS.DIGITALSTEEZ.EU are expressed in RON as the base currency. However, we also display prices in EUR. Exchange rates are updated weekly. Value Added Tax (VAT) included in the price of all products. Transportation costs vary according to product type, quantity and weight. Prices are subject to change without prior notice. If we receive an order from you indicating a different price than the one on the website at that time, we will contact you and offer you the opportunity to cancel your order. All duties and taxes required to receive shipment to the delivery destination must be paid by you. The customer makes payment after the order has been processed. The invoice/order confirmation is automatically generated and sent to the customer’s e-mail.

8. PRODUCTION AND DELIVERY TIME

A PROOF preview is emailed for approval within *3-7 business days after you place an order. Delays may occur during key sales seasons (Black Friday, Cyber Monday, Christmas season or other dedicated sessions) as well as our current workload. During and after this period, design preview may take up to 15 business days. FedEx worldwide delivery takes 3-10 business days, depending on the shipping method selected. Please note that shipping delays may occur due to the high workload of courier companies and are not controlled by DIGITALSTEEZ in any way. The shipping method selected does not affect design and production time.

10. USER ACCOUNTS AND ORDER LIST

DIGITALSTEEZ will make your order list available automatically. You will need to obtain a password to access your orders. The password link will be e-mailed to you.

11. FORTA MAJORA

DIGITALSTEEZ will not be held liable for any delays, failures to perform or any other failures arising from circumstances and obstacles beyond our reasonable control, which include but are not limited to strikes, governmental actions, war or national emergencies, terrorist threats or acts of terrorism, environmental or weather anomalies, third party performance failures, internet connection problems, and hardware and software malfunctions. If such a force majeure occurs, we will try to eliminate any delay as soon as possible.

12. MISCELLANEOUS

You agree that these Terms and Conditions constitute the complete and up-to-date agreement between you and DIGITALSTEEZ regarding the use of this Site and any content on this Site. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Latvia, excluding the United Nations Convention on the International Sale of Goods. DIGITALSTEEZ shall have the right to edit and update these Terms at any time by posting such changes on the Site and indicating any such change by posting a date of the most recent update. Any changes to the Terms and Conditions shall be effective immediately upon posting. You agree that your continued use of the Site after the application of any such changes constitutes your agreement to all such changes.
